As long as there is no issues with virus's etc in that area there is no reason why he should not be respecting the life he took by not letting it be wasted.
Along the east coast, one of the most common methods for humans to contact the prions that cause Creutzfeldt–Jakob disease is through contact with squirrel carcasses (particularly true for people that like squirrel head stew).
So, I think I a good lawyer could get that thrown out without much of a fight. (And actually use it as more justification for eradicating them.)
