BCI is now requiring a seperate sheet be filled out in addition to the 4473 to buy a gun. This is one they keep on file that has all your info and type of gun bought on it. It is in effect a type of registration. Get the work out to everyone and start calling and writting your state reps and congressman.

Is this new form something you were required to complete yourself or does the store provide the info to BCI? Which store does this?
I just emailed BCI and asked them about this directly. Here is what I said;

It has been brought to my attention that BCI is illegally requiring a registration of new fire arms when purchased from an FFL dealer.
I quote from another who has run across this:

Should this be true you will find that a lawsuit will be pending as a result of violating State law. If this is not the case, then please educate me on what this form is as it is not something I am familiar with, or which I have read in the law which is legal to require. Until I hear otherwise I will have to believe you are doing this and will work to ensure that appropriate laws are used in restraining the BCI from further abuses of the 2nd Amendment and of State law.
A response would be greatly appreciated.

maybe I will get a response from them, Lord knows my Representative & Senator don't care to communicate.

has anyone emailed or called Clark Aposhian to see if he knows about this?
Before we worry about this. lets find out what is going on. I haven't heard anything about this. I will be buying a new gun tomorrow probably so I will be curious if I have another paper to fill out.... I'll let you know.

According to the form it is a felony for you or the dealer to not fill out this form. It was something I had to fill out.
Sprfld1911: Do you have a copy of your form? If so, could you scan it, remove any personal information, and post a copy here? It would be great to have a form number or title along with an idea of what it looks like - then we can all contact BCI and ask them what they are doing and why.

When I bought my new gun this past Tuesday I filled out the standard form I always have in the past with the standard questions.There was another page attached to it that I signed, the thing I noticed was they were white instead of the old yellow color.I was told nothing of this new form by the dealer or about any felony for not filling out a form that was to go on file. Did I unknowingly fill out this new form and shouldn't the dealer have been :shock: :oops: :evil: responsible to inform me of it?
Sorry Cowboy. The 4473 changed colors to white not to long ago. The new one is a form you could use off the BCI website if you wanted or not until just the last day or so. Now Im hearing that it is a felony if it isn't filled out but it really isn't legal for them to do in Utah.

I bought an XD45 Compact at Doug's Friday night. No new paperwork for me. Just the normal 4473.
Maybe it's all some new marketing ploy by the gun shops to get your name on a list so they can send you flyers and coupons, and sell your info to other shops! :shock:

This is a form that BCI has never inforced but now that they have a new head lawyer they are enforcing it. It just happened this last tuesday or wednesday. It is BCI's efforts at registering the owner of a new gun.
I will be getting my first and new gun in a day or two, so I will see how many forms I need to fill out.
I'll be getting a new gun in a couple weeks; we'll see what I have to fill out. I'll make sure I get photocopies of everything and will post what I can so everyone can see.

If, in fact, there is a de facto registration happening, I will be in contact with my state representatives and the Utah AG Office.

Here is the response I received this morning from BCI:

Mr. Cagle,

This is not something new. This is in the Utah Criminal Code that all FFL Dealers fill
out this state form and send it in to BCI. We are not allowed to keep these forms for
more than 20 days and no information from this form is recorded. It does have basic
descriptive information of the buyer, what FFL he is purchasing at, and the type of
firearm. This is found in Utah Criminal Code 76-10-526. If you have any further
questions you may contact me.

Um... Sorry Lance, you are wrong. According to Utah Criminal Code 76-10-526 the BCI is only entitled to the following information:

i) the dealer identification number;
(ii) the name and address of the individual receiving the firearm;
(iii) the date of birth, height, weight, eye color, and hair color of the individual receiving the firearm; and
(iv) the Social Security number or any other identification number of the individual receiving the firearm.

There is nothing here regarding 'type of firearm'. The form described in 76-10-526 is the standard form that we all fill out when purchasing firearms, the 4473 form. This BCI communique does not reference or provide legal substance for requiring a second form. Read the code, you will see that it only talks about a singular form. To quote the code: "An individual, except a dealer, purchasing a firearm from a dealer shall consent in writing to a criminal background check, on a form provided by the division." Note that is says FORM, not FORMS.

I do not consider this case closed. I want to know what this extra form is that must be filled out. If it pertains to a background check, that may be a different story. If it is a method of registering firearms or gathering statistical information about firearms, it needs to be stopped per the law.

Would it be possible for someone who has actually seen the form and can describe it to call Clark Aposhian or the BCI and find out exactly what it is and why it's used?

There still hasn't been a single person here that has filled out this phantom form or has a copy of it! Again, I bought a new gun Friday at Doug's. Don't you think one of the bigger gun shops in SLC would be complying with any changes or new forms....... I think this is nothing more than a rumor.
