Heller Files Lawsuit Against New D.C. Gun Regulations



WASHINGTON (AP) -- The plaintiff in the Supreme Court case that overturned Washington's 32-year-old handgun ban has filed a new federal lawsuit against the city.

In a complaint filed Monday in U.S. District Court, Dick Heller and two other plaintiffs allege that the city's new gun regulations still violate rights guaranteed under the Constitution.

The lawsuit cites the District of Columbia's unusual ban on firearms that carry more than 12 rounds of ammunition, which includes most semiautomatic handguns.

The suit also claims that the city's regulations make it all but impossible for residents to keep a gun ready for immediate self defense in the home.

The Supreme Court struck down Washington's handgun ban June 26. The D.C. Council passed emergency legislation July 15 in an effort to comply with the court's ruling.

There's one small mistake in the article. It should read, "The lawsuit cites the District of Columbia's unusual ban on firearms that MAY carry more than 12 rounds of ammunition..." The current D.C. ban outlaws any firearm that can in any way allow more than 12 rounds of ammo, even if they are not currently configured to allow 12 rounds.

The DC Asst DA stated that he would not be surprised if the new regulations brought a new round of lawsuits when enacted earlier this month. Yesterday he stated that the plaintiffs just did not know what the original SCOTUS ruling stated... the man is living in a defiant dreamworld.

Can someone clarify where this is being filed...with a local DC court or directly with SCOTUS?

Don't wait... lets name a day NOW.....

"I hereby with the authority vested in me as a Citizen declare that this day shall forever be known as "HELLER DAY" and propose that the 2nd amendment be sub-titled as "HELLER'S AMENDENT".

Tom Gresham had Mr. Heller and one of his Lawyers on his GunTalk radio show on July 20, 2008 during the third hour. Mr. Heller discussed his attempt to register his handguns with the DC Police.

It's in federal court, but not SCOTUS, probably a lower district court...

This is perfect. If this goes through there can be precedence that a 10+ capacity magazine is not able to be banned. Future benefit would be eliminating high-cap magazine bans.
