I've searched the Utah State Code, but can't find anything regulating private-party firearm sales. Does anyone know where to find the laws regarding a private individual selling firearms? I'm selling a handgun, but I want to make sure I'm in compliance with any laws regulating the sale.

Also, any other advice would be welcome. Even if it's not required by law, would it be advisable to keep a written record of the transaction?

Just searched my copy of ATF 5300.5 and there appear to be no Utah laws regulating the private sale of firearms except to prohibited persons and juveniles. In other words. private sale isn't codified.

I'm no lawyer, so take this for what it's worth.

I've read many of the Utah statutes dealing with firearms. I've also read the excellent book (which I purchased at a gun show):

Utah Gun Law II: Pancho’s Wisdom
by Attorney Mitch Vilos

From all that reading, I don't know of any restrictions in Utah law regarding private-party sales, except that you're prohibited from selling guns to juveniles or to people that you know or have reasonable cause to believe are restricted by law (e.g. felons). Also, don't be involved in straw-purchases.

People find it convenient to go to the gun shows to buy or sell guns between private parties, but private-party sales certainly aren't restricted to those venues. People list guns for sale in the classified ads all the time.
