At approximate 1400 myself and my wife along with my four children entered the Wal-Mart located at 5600 West And 6200 South. I purchased several items and went to the checkout stand. After exiting the store and putting my groceries in the vehicle I was stopped by a West Valley Police Officer who asked to speak with me about a Man with a gun call. I was disarmed by the officer and took my firearm to his vehicle. The officer returned to me asking me for my ID and CFP permit. I was told to wait while he checked me for warrants. While waiting an officer in a White Marked Ford SUV spoke with me about the incident that had occurred. I was told that I could lose my CFP for open carrying in public if I kept this up. I was told also that I lacked common sense. Also in front of the In Store Loss prevention I was told that I was being careless and stupid by doing this. I was held at the scene for several minutes while being questioned by WVCPD. I am a frequent shopper at this Wal-Mart and told I was okay to shop there by store employs that they were just nervous. Upon speaking to Brad Peterson the store manager of that store he stated that he was not well versed on the law. But will call the WVCPD every time he see’s someone walking around wall-mart with a holstered firearm he will always call the police. He is also a concealed firearm holder but not very well versed in the law as he stated. His contact number is 801-840-1698. Don Schultz who is the District store manager was not available to make any comments but his number is 801-840-5064. I welcome anyone who would like to call him or the manager and voice their opinion on this matter should the more the better. I believe this is more of A Wal-Mart paranoia then a WVCPD Issue.

Sounds like Wal-Mart certainly initiated the police contact, but the West Valley Police certainly need to understand the laws better. :disgusted:

They can say that it's not very smart and against common sense all they want, but to threaten that you can lose your CFP for open carrying is worse than ignorant.

edit: if it wasn't so far away and gas wasn't so expensive, I'd go OC at Wal-Mart tonight. For educational purposes only, of course. :D

Perhaps it is time to make that particular Walmart really nervous. Maybe our next outing should be a 1/2 hour walk through that Walmart--buying nothing, just looking and answering questions---with as many of our crowd & Opencarry.com people as we can muster. I think 40 lawfully armed people would be nice. Afterwards we could go to a dinner somewhere nearby.
Maybe this response is a bit on the flippant side however, how else will these ignoramuses ever learn the law? Both Wally World people & WVC PD may really get get an up front education.
Now, this is only a suggestion and not meant to incite anyone. :fudd:

I think the way to handle Wally World is to talk to the District Manager, and on up the chain until we get someone who knows the real policy and sends clarification down.

WVCPD is a tougher nut. Hopefully the discussion at the council meeting will resolve it.

I Emailed Charles Hardy (Utahbagpiper), Mitch Vilos, Clark Aposhian, Rep Curtis Oda and Utah Attorney General Mark Shurtleff the OP's post.

From the Web site of the attorney general, Mark Shurtleff, http://attorneygeneral.utah.gov/44.html, emphasis mine:

Our Mission:

The mission of the Office of the Utah Attorney General is to uphold the constitutions of the United States and of Utah, enforce the law, provide counsel to state agencies and public officials, to work with law enforcement and protect the interests of Utah, its people, environment and resources.

With our team of highly qualified attorneys, investigators and staff members, we ensure the law is upheld and the rights of all citizens â€" no matter how young or old â€" are preserved. We especially focus on protecting children. We also make every effort to educate the public about safety, justice, liberty and equal opportunity.

As we see it, it is our duty to diligently work with integrity every day to fulfill these responsibilities as we serve the citizens of Utah. That is our entire focus. That is our mission.

I would recommend we approach one of our Utah representatives to assist in reaching the AG with the intent of setting up a mechanism or "hot line" to quickly and decisively resolve issues regarding blatant ignorance of the *actual* laws of the state. I am reminded of a snippet from a story provided by Oregon-jet at http://www.ifish.net/board/showthread.php?p=2047316, in which a similarly inappropriate detention occured, where the detained person said that "... Senator Kurt Mackenzie was on the phone and wanted to speak with the officer in charge." THAT is the kind of hotline that would get issues resolved quickly.

That's awfully tempting. I wonder what the WVPD response would be if they get multiple reports of multiple people with guns? How big of deal would it turn into? How difficult would it be to get the press there quickly to report on it? :dunno:

Maybe the press could be called in advance, both TV and Newspaper--get our mission and stance on the issue of the 2nd Amendment and have them follow us through the store and interview others. They would then be on scene when 30 or so WVCPD show up in ignorant arrogance of the law. That could be great
press--free too!
We could also work to getting Mark Shurtleff or Curt Oda or Mitch Vilos, as well as others to be there when this happens. I think that could really put them in their place. Or we could, as many as are able, show up to the WVC Council Meeting next Tuesday the 17th at 6pm in support of TJ and his petition for the Couoncil to crack down on the illegal harrassment of law abiding citizens in WVC by the WVCPD. That might be about as good. Could even get the media to attend that. Hmmmm...

Went there today again to purchase ammo. Walked right up to the counter and asked for the 100 pack of 9mm jhp. The clerk rang it in and asked if it was for a rifle or a handgun, I kinda leaned to my left so he could see my holster and didn't say anything, he looked at my gun and asked if I was 21. I handed him my cfp which I had already removed from my wallet and was holding. He told me the total, I swiped my card got my recipt and walked out no incedent again... Maybe I should try to not be confronted and see what happens :lol3: . I would definitly be in for a large gathering there and I bet I could even talk my wife into coming

Hey Gunsfreak, be sure to come to the WVC City Council meeting with us on Tuesday! We are going to demand that the mayor get with his city attorney and Police Chief and make sure the harassment stops! We are also going to go to dinner at Red Robin or Cracker Barrel afterwards. Maybe swing by Wally World too?

I understand there is a TV Reporter in Utah that gets after those who don't follow the Law. If I remember right he is on CBS and his name is Gepheart (SP) or something like that. Could he be contacted?

Get Gephardt on KUTV channel 2.

He is a "consumer reporter", not a "law reporter".
I doubt KUTV, or any local TV station, would have any interest in this story.
Well, maybe towards the end of June when SCOTUS makes their decision, then maybe they'd want it for a local angle.
Still not a Gephardt story, more of a Rod Decker story maybe.

(I am posting this from inside the very walls of KUTV by the way)
