I just called Whitney. (No answer, left message) I figure where it went down so fast the other day that the person had seen the thread here and just acted on their own to stop using it. Guess I was wrong. Thanks for the heads up again!
EDIT: And the ad is already down again. Probably cause they are posting the ad in HANDGUNS and someone is reporting them. CFP ads can only be placed under SERVICES.

As a side note, if someone would like to go place an add for the forum under services somewhere in an attempt to get new members to the forum that would be awesome. I have no problem with people using the logo and website to boost forum participation or try to get new members here on the forum.

Im guessing the ad keeps getting moved/removed by the moderators because hes putting it in the wrong section. There are no other ads for training in that section, only firearms.

I just talked to Whitney. Whitney is a she. She was very apologetic and it was an honest mistake. She was looking for the BCI certified instructor logo. Anyway, thanks again for the heads up and maybe Whitney will come join the forum and introduce herself!
Incidentaly she said the forum was the first link that came up when she googled utah conceald carry or something like that. We do have a strong internet presence and what we do here does help a lot of people. That should make all of us proud!

Is there anyting legally preventing people from using the logo as "Whitney" did?

Threat of a lawsuit for trademark infringement.. Easier to ask them to stop using it if you don't approve as it would end up involving spending money on lawyers for trademark protection. I'm not sure if this particular logo has been trademarked or not though.

The same law that everyone has been up in arms about on the internet (the one that the music/entertainment industry pushed through, but that sites like google, etc are protesting because it will affect wikipedia and other sites on the internet that share information) should make it easier to prosecute someone for "pirating" images or other content off of someone elses website. Thats actually exactly why wikipedia and google were protesting it.

It would be advisable to edit a TM mark into the logo graphic. Registering it would also be helpful but marking it should be done at a minimum. Of course Paul needs to make sure he has the rights to the Logo. Who designed it and did they grant the rights to Thomas?

The transfer to Paul would have occurred when he bought the forum, if Thomas had ownership of the TM and copyright to the Logo.

Nothing has been trademarks or copyrighted as far as I know. The logo would be part of the property of the forum and would have transferred with the forum. (So I would argue). It's not really a big deal. I am no logo expert but I highly doubt anyone beside the owner of the forum could lay claim to the logo. And any use of the logo for any purpose other than forum purposes would clearly be unethical regardless of the legality. I can see no case where someone would sue to use the logo or I would sue to prevent it's use. It's not really that big of a deal. Anybody using the logo for purposes other than the purposes of the forum would clearly be trying to benefit from something they have no ownership claim over regardless of TM or copyright's. And clearly the logo belongs to and represents the forum. We allow the logo to be used on tshirts and other goodies through the webstore. I guess its something I need to research more. I'm not exactly looking to spend more money on the forum right now I must admit.....

I remember back in the day a couple of threads about creating or at least updating the logo.

From what I found in a quick search of the forum posts for "logo" Thomas asked if anyone could build a logo and submit it, and what we have today was basically a version of that original submission. There were a couple of different members that helped edit it to what it is now.
