A retrial you can't afford is probably better than a conviction you can't afford. I would guess a hung jury is most likely to result in either an offer to plead out to lower charges than may have been offered the first time around. Perhaps less likely, a prosecutor may decline to try the case again.

Thanks for the code cite. And yes, I agree that a 4 person jury is woefully too small. Maybe we should work to increase that for any case which carries a lifetime loss of RKBA or other rights....as a starting point. :D

I also worry about the 3/4ths requirement for a civil case. I can understand why unanimity might be too high a bar for a civil case, but it would be interesting to see if 3/4ths is a high enough bar to make sure that minority views on the jury get heard like they should.

I have a question...Did Trayvon Martin at any time have a hoody with the words..."I'm with Stupid>>" printed on it?

I cant see how the state manages to convict Zimmerman at this point, given the witnesses that have been seen so far. The vast majority of witnesses have ended up saying more things that support the defenses's claim of self defense than they support the states claim of racially motivated murder.

Interesting that in one of the comment threads on LI, Andrew (a self defense lawyer) contradicts the "golden rule" of not talking to cops:

I love how the girl friend said that Trayvon told her he had a 'cracker' following him...was the original attack racially motivated? Possibly, but not necessarily by Zimmerman.

Yeah, most of the states witnesses have done more harm than good to the states case... but "Dee Dee" was a full on train wreck.

The George Zimmerman defense has recently gotten a lucky break. Angela Corey, Florida’s state attorney and the prosecutor against Zimmerman, has been indicted by a citizens’ grand jury for allegedly falsifying an arrest warrant and the complaint that led to Zimmerman being charged with the second-degree murder of Trayvon Martin.

The indictment accuses Corey of allegedly withholding photographs of Zimmerman’s head after the incident. Also, Corey allegedly falsely signed an arrest warrant under oath without including the pictures as evidence. Critics claim that Corey rushed the arrest warrant through because activists were rallying around the Trayvon Martin shooting, demanding that Zimmerman be charged with murder. Critics argue that Corey was attempting to secure a reelection with the support of the activists. What legal status does a "citizen's grand jury" possess? If I get together with my neighbors and convene a "citizen's grand jury", complete with self-appointed prosecutor, and indict Governor Herbert for mopery and other crimes against humanity, what legal meaning does this indictment have? Exactly as much as the "indictment" against Angela Corey. This "indictment" is meaningless because a "citizen's grand jury" has no authority or legal standing.

also, one slight correction to the article... it says

In fact, the state even had to attempt to discredit one of its own witnesses after the individual gave unexpected testimony in favor of Zimmerman.


Actually, it was more like 10 of its own witnesses, not 1. And of the 2 that the state didnt have to try to turn around and impeach, 1 of them ("Dee Dee") pretty much took care of impeaching herself. Pretty much every state witness that gets up on the stand ends up seeming more like a defense witness by the time they step down.

Pretty much seems like a waste of time to me....and certainly not time yet for Zimm to start throwing a victory parade just because of this. However, the defense could still at least mention that Corey is starting to take heat for allegedly falsifying the arrest warrant. When piled on top of everything else thats already happened with the witness testimony, its just one more nail in the coffin the states case is resting in.
